DOJ Sues Denver and Colorado Over ‘Assault Weapons’ and Magazine Bans

The new and somewhat improved Department of Justice (DOJ) took a stand on Wednesday, when the historically embattled agency sued the state of Colorado after filing similar litigation against the city of Denver the day prior.

The federal government struck back at state and city statutes that make possessing or selling so-called “assault weapons” that have a capacity to hold more than fifteen rounds of ammunition against the law. This is a direct product of the administration’s creation of the “Second Amendment Section.”

Lawmakers used capacity to demonize commonly owned firearm accessories

In its filing, the DOJ charged that Colorado’s anti-gunners hijacked “large capacity” as a description of ordinary ammunition magazines. Then they weaponized it through “politically charged rhetoric” to demonize millions of law-abiding firearm owners.

“The magazine ban bans bearable arms,” the DOJ noted. “Therefore, the magazine ban implicates the plain text of the Second Amendment.”

Assistant Attorney General Harmeet K. Dhillon, the leader of the DOJ’s Civil Rights Division, responded to the Wednesday reveal. “Colorado’s ban on certain magazines is political virtue signaling at the expense of Americans’ constitutional right to keep and bear arms.”

Of course, Colorado is one of several states locked in heated battles for political office. One of the contenders for governor, Attorney General Phil Weiser (D), won the state’s March Democratic primary despite virulent opposition to gun rights.

“Large-capacity magazine laws are responsible policies that satisfy Second Amendment protections, decrease the deadly impacts of mass shootings, and save lives,” Weiser claimed after the twin filings this week. “The state has a duty to protect Colorado residents from gun violence, and I will vigorously defend our state’s large-capacity magazine limit law from this attack by the Trump Justice Department.”

Washington Gun Law President William Kirk was one of many encouraged by the DOJ moves. 

“This is exactly what we had hoped for,” he said, observing that the current statutes in Colorado and Denver criminalize constitutionally-protected firearms owned by tens of millions of Americans.
