Even as the White House proposed permitting handguns to be mailed through the Postal Service, the same as rifles and shotguns, a Michigan lawmaker seeks to head off the rule change at the pass.
On Friday, Rep. Haley Stevens (D-MI) introduced a bill to block efforts to reform the total prohibition on private citizens mailing these weapons.
The Hill reported that the measure would prevent USPS officials from “finalizing, implementing, or enforcing” any rule change concerning firearms in the mail system. The ban dates back nearly a century, and the Michigan representative believes that it is somehow necessary to maintain it.
Representative tried to tie USPS ban to ‘illegal guns’
“Michiganders want common-sense safeguards that protect families and support law enforcement, not reckless policies that create new loopholes for illegal guns,” Stevens claimed in a statement to the outlet. “The last thing we should be doing is making it easier for handguns to move through the mail.”
Give Stevens, who is currently campaigning for the U.S. Senate, at least a little credit for nailing nearly every empty buzzword deployed by anti-Second Amendment radicals.
DOJ declared the prohibition on mailing concealable weapons unconstitutional
The Department of Justice (DOJ) already weighed in on the issue. Officials released an opinion in January declaring the 1927 federal statute prohibiting the USPS from delivering concealable weapons unconstitutional.
Assistant Attorney General for the Office of Legal Counsel T. Elliot Gaiser noted in the opinion that law-abiding citizens face undue burdens with the law, which was enacted during Prohibition.
“The statute also imposes significant barriers to shipping constitutionally protected firearms as articles of commerce, which interferes with citizens’ incidental rights to acquire and maintain firearms,” Gaiser wrote.
Under the current proposal, these firearms would be subject to the same regulations as rifles and shotguns. Private citizens may mail these items as long as they are not loaded and are packaged properly.
