The controversial National Firearms Act of 1934 (NFA) is already crumbling, and a Colorado congresswoman wants to put another nail in its coffin.
Rep. Lauren Boebert (R-CO) on Wednesday introduced the Freedom from Taxes Act of 2026. The NFA charge on machine guns and destructive devices, currently at $200, would be slashed to $0, a substantial change that would benefit many law-abiding gun owners.
GOA declares the “unconstitutional” tax needs to go
Gun Owners of America (GOA) threw its full endorsement behind the bill, declaring that its successful passage would complete gun rights reform measures begun in the last federal budget.
“For the last 92 years, law-abiding Americans have had their Second Amendment rights infringed through a draconian and unconstitutional $200 ‘sin’ tax on the transfer of each machine gun,” GOA noted.
GOA Senior Vice President Erich Pratt commented on the issue occurring simultaneously as the 40th anniversary of the Hughes Amendment, the 1986 law that rewrote the rules on civilian machine guns. He declared his organization opposed the change four decades ago and that it “still opposes any infringements on the right of the people to keep and bear arms.”
Representative believes NFA has long outlived its usefulness
As for Boebert, she spoke out against the idea of the government taxing constitutional rights as if they were products or services with a price tag.
“Taxing our constitutional rights is unacceptable and unconstitutional,” Boebert asserted. “The government should not be imposing penalties on law-abiding citizens exercising their Second Amendment rights.”
According to Guns.com, there are millions of items that fall under the NFA’s purview, including 782,958 machine guns and 3,212,547 destructive devices. These can include a range of products, such as explosives and live grenades.
Next on Boebert’s list? Taxes that are still imposed on licensed dealers and NFA item manufacturers.
