It’s not always overzealous and ill-informed politicians and officials who are not well-versed on the Second Amendment. A controversy exploded in Florida when a homeowner’s association jolted residents with new restrictions on lawful firearms.
The Port St. Lucie organization must know and just not care that thousands of its residents are gun owners and deserve the right to armed self-defense.
Now they certainly know, as Florida Attorney General James Uthmeier directly told them, they are “not at liberty to adopt arbitrary or capricious rules bearing no relationship to the health, happiness, and enjoyment of life of the various unit owners.”
Residents told they could not carry in community’s common areas
In a May 11 letter, the Tradition Community Association cautioned some 10,000 residents of the community that they could no longer freely exercise their Second Amendment rights.
“The board has recently approved a rule regarding the carrying of weapons in Tradition Community Association common areas,” property manager Angela Shepherd declared. “In essence, carrying a firearm or other weapon, either openly or concealed, is not permitted in Tradition Community Association common areas.”
Shepherd added that even residents with a concealed carry permit are barred from carrying.
Residents are fortunate to have 2A-supporting law enforcement officials
Now comes word that local authorities are not on board with this usurpation of gun rights. The Port St. Lucie Police Department announced it will not enforce the restriction in a terse Facebook post.
“It is important to clarify that the letter distributed by the HOA is not a law, ordinance, or official directive issued by the Port St. Lucie Police Department or the City of Port St. Lucie,” the open letter explained. “The Port St. Lucie Police Department enforces Florida state law—not private HOA policies or community association rules.”
Police Chief Leo Niemczyk made it clear that his department supports the free expression of Second Amendment rights and will not target lawful owners.
