It is difficult to comprehend how a baseless lawsuit against the Second Amendment-protected firearms industry could meander through the court system for 26 years, but here we are.
At long last, the frivolous action brought by officials in Gary, Indiana, in August 1999 against a vast array of weapons manufacturers, distributors, and dealers is no more.
On Thursday, the Indiana Supreme Court drove the final nail in the lawfare when it refused the City of Gary’s petition to move its case against the industry. The tally was 4-1, and that sealed last December’s Court of Appeals decision to finally dismiss the case.

Before the turn of the millennium, the city decided that, instead of cracking down on out-of-control criminal violence, it would take a different approach.
That scheme was to sue high-profile industry members and appease its anti-gun base. Interestingly, it was not a jury that buried the suit, but a law known as the Reservation Statute that ultimately did the trick.
Under the new law, only the State of Indiana may bring such legal action on behalf of a municipal or county government. Legislators made the statute retroactive to three days before Gary officials filed it 26 years ago, leaving the lawsuit buried in the dustbin of history.
Critics still believe inanimate objects are the guilty parties
The Second Amendment community is accustomed to such attacks, and it is encouraging to see another one fail. Of course, anti-gunners were quick to wail that the sky is falling and that the state was completely misguided for protecting its citizens’ constitutional rights.
Brady President Kris Brown released a statement vilifying the high court for finally squashing the frivolous lawfare.
“What happened here should shock and terrify anyone wanting to access the courts to seek accountability,” she said. That was just a preface to an attack on the judicial process and the voters’ obvious will, which she called “a weak and sad path.”
