Supreme Court Ends Session with Split Decisions on Young Adult Carry

The U.S. Supreme Court concluded its recent session with a flurry of activity on Second Amendment issues. Rulings affirming the rights of marijuana users to keep and bear arms and striking down Hawaii’s “vampire rule” encouraged the shooting community.

The court also agreed to consider two challenges to bans on “assault firearms” in the fall, a notable win for gun rights advocates.

On the lingering issue of young adult carry, however, justices delivered mixed results. The high court declined to take up a case challenging the federal law against 18-to 20-year-olds purchasing handguns and another involving the Florida statute prohibiting the buying of all firearms by this group.

High court let two previous rulings in favor of gun rights stand

Then there was good news.

The Supreme Court refused to hear Pennsylvania’s arguments in support of its law banning young adults from carrying weapons during a state of emergency. The Second Amendment Foundation (SAF) and Firearms Policy Coalition (FPC) already won in two prior lower-court rulings on the issue.

Had justices accepted the case, it would’ve meant an important chance to extend the results nationwide. Instead, a partial and localized win emerged.

Victory for young adult carry in Pennsylvania is a positive sign

This win is another step toward chipping away at unlawful restrictions on young adults by lawmakers who do not consider them to be part of “the People.”

SAF Executive Director Adam Kraut noted the group’s disappointment with the decision but chose to look on the bright side.

“While a cert grant on this case could have meant an opportunity for the Supreme Court to take our win in the Third Circuit and apply it nationally, we are still content that our victory in this case is now permanent and final,” Kraut explained. “Adults under 21 enjoy all the same constitutional rights as their older adult counterparts, and the rights protected by [the] Second Amendment are no different.”

The SAF hopes to use the ruling’s momentum to dismantle similar restrictions in Pennsylvania and elsewhere.
