SAF Cites Confusion After NFA Registration Ruled Unconstitutional

To be sure, there is much excitement in the sporting community following the permanent injunction against NFA registration and the Department of Justice’s (DOJ) initial decision not to appeal the judge’s ruling.

But the decision’s aftermath is fraught with uncertainty, and the federal government is not currently helping. 

Seeking clarity, the plaintiffs in Jensen v. ATF sent a letter to the DOJ and ATF asking for a “speedy response.” This followed some Texas residents being able to purchase suppressors and other NFA items without the previously mandated paperwork, while others were turned away.

Injunction’s real-world results are decidedly uneven

The Second Amendment Foundation’s (SAF) Adam Kraut explained that the confusion cries out for “guidance from the government that will come with law-abiding Americans seeking to avail themselves of this injunction.”

Kraut noted that the murky aftermath following the initial celebration should be untangled so upstanding citizens can fully exercise their right to keep and bear arms.

“To better help educate anyone covered under the ruling, Plaintiffs and their counsel determined the best path forward was to ask the ATF and DOJ directly about how the government plans to comply with the court’s judgment,” Kraut wrote. “We’re hoping for a speedy response so the public can better understand how this ruling affects them.”

Plaintiffs asked important questions on behalf of Second Amendment community

Specifically, the letter asked about guidance for both dealers and the public, whether those not covered by the injunction are still subject to prosecution, how authorities will ensure that those freed from the requirement will be adequately protected, and, if the injunction is later modified or dissolved, how items acquired while it was in effect will be treated.

A judge for the U.S. District Court for the Northern District of Texas recently determined that the residual NFA registration mandate that survived the elimination of the tax on suppressors, short-barreled rifles and shotguns, and other items was unconstitutional.

Observers rejoiced when the government initially declined to appeal the decision, though it still has several weeks remaining to reverse course.
