The fight against government attempts to regulate hobby weapons out of existence produced a milestone victory on Thursday. The Firearms Policy Coalition’s (FPC’s) years-long battle in Rigby v. Jennings resulted in a rousing win for gun rights.
The U.S. District Court for the District of Delaware ruled that the ban on crafting personal weapons, on hold due to a preliminary injunction scored by the FPC, is unconstitutional.
The court left no doubt about the ban’s negative consequences for upstanding citizens.
Law-abiding Delaware residents forced to give up weapons
“Plaintiffs have been forced to dispossess themselves of firearms they lawfully owned before Delaware passed the Possession and Manufacturing and Assembly Bans,” the district court opinion said. “Now the only thing preventing them from exercising their Second Amendment rights to repossess those firearms is an unconstitutional statute.”
The court added that stripping this freedom “for even minimal periods of time unquestionably constitutes irreparable injury.”
Delaware’s doomed law, which the state may attempt to resurrect on appeal, was part of the push by anti-gunners to eradicate the centuries-old tradition of crafting personal firearms. Authorities pinned their arguments on wild claims of ‘ghost guns’ terrorizing the populace.
District court left no doubt that such weapons are in fact ‘arms’
The court rejected the defendant’s attempts to classify unserialized weapons and parts as beyond the Second Amendment’s scope. Instead, the ruling noted that “all firearms constitute ‘arms,’ whether serialized or not.”
FPC President Brandon Combs took state officials to task for reclassifying law-abiding citizens as criminals with a stroke of the pen.
“Delaware tried to turn peaceable people into criminals for possessing firearms they lawfully made and owned,” the gun rights defender declared. “Today the court correctly held that the Second Amendment protects the People’s right to acquire arms by building them at home. Nearly four years after we secured a preliminary injunction against these bans, we now have a merits ruling holding them unconstitutional.”
