San Jose Officials Warned Over Outrageous Carry Permit Fees

Second Amendment rights often come with a state-mandated price tag, which should upset freedom-loving Americans. When that financial hurdle makes their free exercise nearly impossible for rank-and-file citizens, it is a call to action.

Last week, the Department of Justice (DOJ) notified San Jose’s mayor, chief of police, and city attorney that the California city’s indefensible charge for carry permits will be countered with a federal lawsuit if it is not immediately modified.

Assistant Attorney General Harmeet Dhillon sent the scathing letter to officials warning that aggressive legal action is looming.

The people should not lose freedoms because they cannot afford them

Dhillon, a formidable defender of gun rights, posted the letter the DOJ sent to the California city on X and stated the obvious: local governments are parceling out liberty for a fee.

“Constitutional rights aren’t for sale,” the AAG declared. “Charging $1,600 to carry a firearm outside the home is unconscionable and unconstitutional. The @CivilRights Division is working hard to protect San Jose’s residents from Second Amendment violations!”

It should be noted that San Jose’s exorbitant fee is far above similar requirements by other gun-control-dominated California municipalities.

DOJ targeting city officials who carry out the scheme

The letter revealed that the DOJ is not ready to challenge the city’s ridiculous system on Second Amendment grounds. Rather, the agency intended to pursue relief for gun owners due to law enforcement misconduct.

“San Jose’s law enforcement officers are charged with enforcing its abusive licensing scheme and are doing so,” the missive read. “Such law enforcement conduct is unlawful. This letter is to inform you that as Assistant Attorney General for the Civil Rights Division, I have authorized the filing of a complaint in federal district court against the City.”

For good reason.

Paying $1,591 to carry away from home lawfully may be pocket change for some, but it is a chilling barrier between most good citizens and the free exercise of their fundamental rights.
