California officials are hellbent on nullifying the Second Amendment, and anything gun-related they cannot outright ban, they are more than happy to throw arbitrary obstacles in the way of. Take gun barrels, for example. Tubes.
The Second Amendment Foundation (SAF), fresh off a series of impressive legal gun rights victories, weighed in on Friday with the California Department of Justice on the proposal.
The state wants to conduct criminal background checks for every transfer of firearm barrels. That’s right, and next it’ll be scopes, holsters, and backpacks that hunters store random accessories in. Senate Bill 704 is the first such effort nationwide and hopefully the last.
Proposed rule is just another way to inconvenience gun owners
SAF Director of Legal Research and Education Kostas Moros blasted the Golden State for erecting every possible barrier between upstanding citizens and their Second Amendment rights.
“California already prices and papers the right to keep and bear arms nearly out of reach,” Moros declared. “Now it wants a background check just to buy a barrel. If the Department insists on building this system, it should not copy the ammunition regime’s worst feature: rejecting tens of thousands of law-abiding people for a name or address mismatch and never telling them they can still complete the Basic Check.”
Officials will have difficulty finding a historical precedent
As for the required Bruen test, to say there is no historical analogue for such modern foolishness is the understatement of the year.
No matter to the state DOJ, which is plowing ahead with this latest round of unconstitutional rulemaking. The goal is to create a “Standard Firearm Barrel Eligibility Check” which would operate similarly to the current ammunition protocols.
As Moros explained, a potential purchaser whom the state rejects, perhaps mistakenly, can still go on to a Basic Check. However, this isn’t automatic, and dealers aren’t required to relay this important detail to their clients.
And when it comes to California, “trust us” is not a viable option.
