Here we go again.
Less than three weeks after Florida’s attorney general crushed the anti-Second Amendment policies a homeowner’s association attempted to enforce, another popped up this week with a virtually identical scheme.
This time, it’s Forest Pines Condominiums in Horry County, South Carolina. The HOA informed residents through an email that legal firearms are prohibited, “whether open or concealed,” in common areas.

These include the clubhouse and bathrooms, parking areas, the pool and adjoining deck, sidewalks, the mail kiosk, and virtually anywhere that is not the resident’s dwelling or their vehicles.
The Florida example should serve as a warning to other HOAs that believe they have the authority to overrule the Second Amendment. And while this scheme might fly for a while in California, New York, and now Virginia, it faces a crisis in the Palmetto State due to current law.
South Carolina allows private property owners to ban firearms if there is specific signage warning the public that weapons are prohibited. None is reportedly apparent at Forest Pines, but that’s far from the central issue.
Resident responds to controversial HOA email
A female resident told reporters that she is not bothered by the ban on firearms in the pool area, but she wonders if the HOA is ready to assume liability when she is stripped of gun rights around her home.
“What if I go out at night and I’m like walking, so if I get mugged, are they now financially responsible? Because I was not permitted to protect myself in the middle of the street,” she asked.
The resident further explained that hers is not an apartment building with a common lobby. “It’s my house. I don’t rent it; I own it.”
South Carolina is one of 29 states where law-abiding citizens have the right to carry firearms without government permission. In the Florida case, AG James Uthmeier quickly stepped in and corrected the HOA’s overreach.
Authorities in South Carolina should follow that shining example and protect Second Amendment rights against these misguided groups.
