Young adults in Delaware are entitled to full Second Amendment rights, according to a court ruling last week.
The Kent County Superior Court determined that House Bill 451, an anti-gun measure signed by former Governor John Carney (D) three years ago, violates the state Constitution.
The age requirement for gun rights also established mandatory adult supervision for hunters under the age of 21. Of course, this angered the sporting community as it interferes with time-honored traditions handed down through generations of Americans.
US courts are divided on gun rights for young adults
The court noted that judges across the country continue to strike down these controversial laws. On the other hand, others affirmed their constitutionality, leading to the current conundrum.
Judges wrote that 18-20-year-olds have legally been adults in Delaware since 1972. They concluded that current state law protects the rights of young adults to fully participate in society, and part of that participation is the free exercise of Second Amendment rights.
A major restriction is now eliminated—just in time for hunting season
Superior Court Judge Reneta L. Green-Streett wrote that “at a minimum, some provisions of HB 451 infringe on the right of a subsection of adults, aged 18 to 20, to exercise their right to ‘defense of self, family, home, and State.”
While Delaware’s anti-Second Amendment regime mourns the latest setback, gun owners and sportsmen are thrilled. Not only does the ruling strike back at the most recent state overreach, but it did so just before the opening of hunting season.
Jeff Hague is the executive director of the State Sportsmen’s Alliance. Though he expressed frustration that it took three years to reach this pivotal decision, he is happy for Delaware residents. “We believe that all the laws that they passed in 2022 are unconstitutional, and this just affirms our beliefs from three years ago.”
