It’s a new day for the Department of Justice (DOJ), and those of us who have become accustomed to seeing Second Amendment rights trampled on now have new cause to celebrate.
The DOJ requested to deliver oral arguments in Barnett v. Raoul, the challenge to Illinois’ insidious ban on popular sporting rifles. That’s a far cry from recent years of institutional opposition to the right to keep and bear arms.
Justices will hear arguments on September 23.
The DOJ believes that Illinois blatantly ignored Bruen in banning popular sporting rifles
The federal brief is straight to the point in its support of protecting Second Amendment rights.
“Three years ago, the Supreme Court issued a landmark decision meant to break a habit developed by some states of treating the Second Amendment as ‘a second-class right, subject to an entirely different body of rules than the other constitutional rights,” the DOJ declared. “Regrettably, not every state got the message. Just a few months after Bruen, Illinois outlawed some of the most commonly used rifles and magazines via a so-called ‘assault weapons’ ban.”

The brief added that the Court’s clear guidance protects arms that are in “common use.”
If successful in its petition, the DOJ’s Civil Rights Division will present its arguments before the high court that the Illinois prohibition on so-called “assault weapons” is unconstitutional.
It was January 10, 2023, when Illinois enacted the poorly named “Protect Illinois Communities Act” (PICA), which rolled out a sweeping ban on semi-automatic weapons. It included a prohibition on “large capacity” magazines that hold 10+ rounds for long guns and 15+ for handguns.
The case before the Supreme Court is an essential opportunity for justices to right a wrong and further safeguard the Second Amendment against state encroachments.
