On Tuesday, Chief U.S. District Judge Reed O’Connor of the Northern District of Texas dealt yet another blow to Biden-era gun control overreaches.
The so-called “ghost gun” rule, commonly referred to as the frame and receiver rule, was deemed unconstitutional as it violates the Second Amendment right to keep and bear arms and Fifth Amendment due process protections.
Court victory should pave the way for broader relief
The Second Amendment Foundation (SAF) was a plaintiff in Defense Distributed v. Blanche, and the gun rights organization took a well-deserved victory lap after the win.
“The court declared the rule unconstitutional as applied to all SAF members, and issued a permanent injunction protecting Defense Distributed and current and future Second Amendment Foundation members as it relates to the specific gun kits involved in the case,” the SAF posted on Facebook. “In plain English, SAF members are now expressly protected from enforcement of this rule specifically involving these specific products under the court’s order.”
Hobbyists for centuries have used considerable skill to construct their own firearms
Legal action followed the April 2022 issuance of the ATF rule prohibiting these gun parts, which hobbyists use to construct their personal weapons.
SAF Executive Director Adam Kraut blasted the previous administration for putting forth such an indefensible infringement on the right to keep and bear arms.
“This rule was such a mess that it not only violated the Second Amendment but was so terribly drafted that it managed to be ruled unconstitutionally vague,” Kraut noted.
He added that the court found that the rule “was written in such a vague and vaporous manner as to chill that protected conduct by making it impossible to even know what was legal and what wasn’t.”
Judge O’Connor was clearly not swayed by government bureaucrats labeling “a hunk of metal or plastic” as a dangerous item that may easily be converted into a functioning firearm.
That is Congress’s role, as any freshman government student knows.
