Anti-gun states such as California, Illinois, and New York regularly draw the ire of those who value the fundamental right to keep and bear arms. But for pure animosity toward the Second Amendment, few if any can compete with Hawaii’s egregious track record.
But there’s good news this week from the Aloha State as a gun owner successfully challenged his denial of a “permit to acquire” a weapon. What was the reasoning for withholding permission for Paul Kealoha to defend himself?
A 2024 incident involving feral hogs. Kealoha, a retired lifeguard and lifelong Hawaii resident, helped neighbors remove thousands of these animals over the past decade.
No laws were broken or charges filed, but a good citizen was still denied their gun rights
Understand that Hawaii officials prefer that virtually no one is armed.
Last year, Kealoha was asked to eradicate an infestation of wild pigs, which is legal in the state.
Someone called the police when they heard gunfire. Authorities responded but quickly determined that nothing nefarious was underway—just something that folks in rural areas deal with regularly.
But that alone was enough to deny a law-abiding citizen their Second Amendment rights.
Judge issued powerful rebuttal to Hawaii authorities
U.S. District Judge Micah W.J. Smith corrected this situation with a scathing order from the bench. He instructed Hawaii officials to “not deny any PTA based only on a police report if the applicant is not also being prosecuted for a felony, a crime of violence, a criminal offense related to firearms, or an illegal sale or distribution of any drug in a court in this state or elsewhere…”
The complaint correctly charged that the gun control regime made it “extremely difficult, if not outright impossible or impermissibly time-consuming” for the people to receive this “permit to acquire.”
