The U.S. Department of Justice (DOJ) must be applauded for its newfound belief in Second Amendment rights, clearly demonstrated by several recent actions.
It just takes one judge, however, to throw the most reasonable request to defend individual freedoms into the junkpile. The latest is U.S. District Judge Monica Ramirez Almadani, who on Thursday saw fit to reject the DOJ’s request for a temporary restraining order against California’s ban on popular Glock handguns and similar firearms.
DOJ sought to stop enforcement of Glock ban as its lawsuit moves forward
The DOJ last week sued California officials over Assembly Bill 1127, the state’s latest attack on the right to keep and bear arms. All pistols equipped with cruciform triggers are prohibited in the Golden State because some criminals illegally modify them.
Acting Attorney General Todd Blanche declared, as the lawsuit was filed, that California authorities “cannot ban the most popular type of handgun in America.” According to at least one judge, they can.
Judge declined to rule on the merits of the DOJ’s pending case
Almadani ignored the likelihood of success for the plaintiffs. Instead, she determined that the DOJ’s suit somehow ran afoul of the federal law the Civil Rights Division used to protect 2A rights from California’s gun grabbers.
In other words, a technicality.
The state’s Glock ban breezed through the legislature last year and was quickly signed into law by Gov. Gavin Newsom (D). This is the same Gavin Newsom making noise about a White House run in 2028, and the same politician who vocally supports exporting California’s oppressive gun control apparatus nationwide.
Keep in mind that the state already tramples on the Second Amendment with its authoritarian and expanding list of prohibited weapons.
Just last week, the U.S. Supreme Court agreed to hear a consolidated challenge to the constitutionality of state and local AR-15 bans. Deciding to accept a challenge to multiple laws making owning the most popular handguns in the U.S. should be next.
