With a landmark challenge to state and local bans on AR-15s and other sporting rifles on the U.S. Supreme Court docket, anticipation is high for a resolution on this volatile Second Amendment issue.
Now there’s a date to circle.
Arguments in long-overdue decision are now scheduled
The high court calendar revealed that oral arguments in the combined cases of Viramontes v. Cook and Grant v. Higgins are set to begin on Wednesday, Dec. 2 at 10 a.m.
SCOTUSblog noted the dual nature of the challenges before the court. “Cutberto Viramontes filed the challenge to the ban on semi-automatic rifles in Cook County, Illinois, while gun owners and gun rights groups challenged a similar law that Connecticut passed in the wake of the 2012 mass shooting at Sandy Hook Elementary in Newtown, Connecticut.”
Both cases reached the Supreme Court after lower courts upheld bans on modern sporting rifles owned by tens of millions of law-abiding Americans.
Civil libertarians hope justices will rely on the Second Amendment and established precedent to rule that state and local governments exceed their authority when they enact sweeping prohibitions on these commonly held firearms.
Guidance from SCOTUS will come in 2027
Expect gun rights organizations and supporters, particularly the Second Amendment Foundation as a plaintiff in both cases, to follow the proceedings with enormous interest.
They’ll have much to observe and interpret as justices are likely to hear from attorneys for both sides through as late as Spring. The scope of the pending ruling is unknowable at this point, but it should go far in clarifying if AR-15s and similar firearms are part of the “arms” protected by the Bill of Rights.
As TheGunMag.com recently noted, new data reveals that these weapons are used in only a small percentage of violent crime.
Despite the best efforts of anti-gun radicals to paint them with a deadly brush, more Americans are killed by knives, blunt objects, or fists and feet annually than with these so-called “weapons of war.”
