Robberies don’t always unfold in the dead of night at a dark and isolated location. One such violent encounter erupted on Sunday in the late afternoon at a gas station in Lincolnton, North Carolina, and the intended victim decided to flip the script on the would-be robber.

Police were called around 5:30 p.m. to the BP station on East Main Street for an attempted robbery and shooting. What they found was an injured suspect and a man who by all accounts legally defended himself.

Investigators report 39-year-old Billy Ray Galloway of Denver attempted to steal a customer’s vehicle. He is believed to have jumped into the vehicle brandishing a knife.

Only, the customer did not cooperate.

Another gas station customer, Aysia Silvers, witnessed the shocking encounter and told police that she heard the argument between the two before the gunshot went off. She said the windows were up in the vehicle but she could hear the altercation.

Silvers said Galloway exited the vehicle and walked around to the driver’s side. That was when the intended victim stepped out and shot him in the leg.

The witness explained, “It happened so fast. The driver got out and shot him. We all, my mom and my siblings, we just [had] instant tears, [we] were shaking.”

Galloway was injured but survived the shooting. The witness dialed 911 to summon authorities, and the alleged perpetrator was transported to a local hospital.

He reportedly suffered only minor injuries and remained at the scene until the police arrived. After being treated, Galloway was incarcerated at the Gaston County Jail. 

Silvers told local media that it was not until she spoke to law enforcement that she realized the incident was an attempted carjacking. “To be honest, I’m going to say, it’s self-defense.”

Undoubtedly the police and prosecutors will agree.
