Whatever obvious flaws they normally possess, anti-Second Amendment radicals are at least consistent in their persistence in trying to strip away the right to keep and bear arms. Even when they know they will certainly be defeated.
Take Minneapolis Mayor Jacob Frey (D), for example.
With full knowledge that Minnesota’s preemption law is in effect to stop the very same measures he trumpets to his constituency, His Honor took grandstanding and political posturing to a level that is all too common with gun rights opponents.
Lawmakers passed city law that is illegal under state law
The so-called Safe Firearms Act prohibits the most popular sporting rifles, including the AR-15 and similar weapons, along with privately constructed weapons that are unserialized. It further expands restrictions on lawful carry in specific public places and sets storage requirements.
Of course, the state’s preemption law means that this action is merely a tempest in a teapot—for now.
Minnesota’s lawmakers are strongly divided on gun rights, and it would not take much imagination to see the state government buckle to pressure from Minneapolis.
City hopes to have a running start if preemption law crumbles
As the law is currently constructed, local governments are prohibited from enacting any gun control that goes beyond such laws at the state level. Local entities are free to pass and enforce statutes that mirror state law, and they can decide where firearms may be legally fired.
The hope, and it is not far-fetched, is that the balance of power will shift enough so that the city law will become enforceable.
Frey admitted as much, acknowledging that the Safe Firearms Act is meaningless for the time being. “This is going to set us up so that if preemption is lifted, Minneapolis won’t need to act because we already did.”
The Minnesota Gun Owners Caucus is considering possible legal options against the toothless law. In a statement before the vote, the 2A advocacy group warned that local governments are not free to “simply ignore state statute because they dislike the policy outcome.”
