Anti-gunners are scraping the bottom of the barrel in their headlong rush to eradicate the right to keep and bear arms. Just how far they will go was put on display in a public nuisance lawsuit filed against three Maryland gun shops.

A Maryland Circuit Court judge tossed the plaintiff’s case into the trash bin.

The three lawful businesses, Atlantic Guns, Inc., Engage Armament LLC, and United Gun Shop, were sued by Maryland and the District of Columbia in 2024.

The litigants claimed that a man, Demetrius Minor, made “straw purchases” of firearms at the three shops for individuals who would be rejected by the mandatory background check.

Minor passed the mandated checks at all three locations, absolving them of any shred of blame for future actions.

Despite this, the plaintiffs claimed that the entrepreneurs should have known that Minor was a straw purchaser. No evidence was presented to the court to back up this supposition.

Instead, the court noted that Minor held a Maryland Handgun Qualification License and passed the checks. That approval meant that the Maryland State Police could also be blamed if the plaintiff’s reasoning held up.

It did not.

The judge wrote, “The court will not consider allegations in the complaint (or arguments concerning those allegations) that are based on or derived from ‘trace’ data. This data [is] maintained by the Bureau of Alcohol, Tobacco, Firearms and Explosives, largely for law enforcement investigative purposes.”

The detailed explanation continued. “Use of such data is expressly barred by federal law, which provides, among other things, that trace data ‘shall not be used, relied on, or disclosed in any manner, nor shall testimony or other evidence be permitted based in the data, in a civil action in any State…or Federal Court.”

In fact, the only evidence that Maryland and Washington, D.C. presented was this trace data, which was inadmissible by federal law.

Game, set, match. Case closed.
