An apparently complex domestic situation erupted in violence Sunday evening in Idaho, and the fallout left 50-year-old Jason Leroy Sparks dead. He was the ex-husband of Ashley Sparks, and the alleged shooter now shares a home with her.
The former husband reportedly was at the Kootenai residence working on her vehicle when, for reasons unknown, he walked into the dwelling and attacked 21-year-old Shawn Webster.
Sheriff’s office described a chaotic scene that exploded Sunday
The older man allegedly made previous threats against Webster, and the Bonner County Sheriff’s Office (BCSO) pieced together events that led to the fatal shooting.
Just before 7 p.m., Sparks entered the home apparently uninvited.
“Shawn retreated to his bedroom and armed himself with a pistol,” the sheriff’s office said. “Jason followed Shawn into the bedroom, grabbed him by the throat and started to lift him off the ground. In response, Shawn fired a single shot into Jason’s neck, stopping the attack and ultimately killing Jason.”
Prosecutors may not agree with BCSO’s conclusion on the shooting’s justification
Immediately after the shooting, the young man went to a nearby gas station and called 911. First responders pronounced Jason Leroy Sparks dead at the scene.
The BCSO quickly noted that the violent incident likely falls under Idaho’s “Castle Doctrine.”
“Idaho’s Castle Doctrine permits the use of deadly force against an unlawful intruder in your home, workplace, or occupied vehicle,” officials explained in a release. “It remains the legal duty to retreat and establishes a presumption that you reasonably feared for your life when facing a forced, unlawful entry.”
The prosecutor may of course see otherwise, but Webster apparently fulfilled his obligation to “retreat” until he had no other choice.
Along with the obvious trauma of taking another person’s life, defenders must wait on the legal system to determine if their actions in the confusion of a violent attack bring legal consequences with them.
