In real estate, they say that “location” is everything. The same rule, unfortunately, applies to law-abiding Americans who exercise their Second Amendment rights for self-defense.
In some locales, the intended victim must worry about overzealous prosecutors who frown on citizens being their own first responders. For one Texas apartment dweller, he may well be lucky to reside in the Lone Star State and not California or Illinois.
Dramatic early morning encounter leads to gunfire
According to Arlington Police investigators, the intended victim heard a noise just after 5 a.m. Friday morning and went out to check on the source. What he encountered was startling.
A suspect was allegedly cutting the catalytic converter off his vehicle.
What followed is unclear, but a shot was fired and the suspect went down. Responding officers found him wounded in the apartment parking lot, and he was transported to the hospital in an undisclosed condition.
Shooter must now wait for a decision on charges
Police reported that the shooter was there when they arrived and cooperated fully with the investigation. He has not been charged, and the investigation remains open.
Authorities will closely examine the confrontation between the suspect and the vehicle’s owner. Texas grants wide latitude to law-abiding citizens who violent criminals threaten, and officials may well determine that the apartment resident was within his rights to engage in armed self-defense.
Again, location.
If the shooter had reason to believe he faced an immediate threat of physical harm, he would almost certainly walk free. The Texas Penal Code clearly establishes that an individual has the right to use force if they are faced with another person doing the same.
On the surface, the vehicle owner had every right to be in the parking lot. The question that must be answered is whether he was threatened and left with no choice but to respond in the manner that he did.
