On the day just before Connecticut’s contentious Glock ban was to take effect, a federal judge temporarily blocked its enforcement. The company, along with the National Shooting Sports Foundation (NSSF) and two individuals, joined forces in NSSF v. Griffin.
There was no ambiguity about how the jurist felt about the merits of the Second Amendment case.
Attorneys did not establish precedent for ban in nation’s historical tradition of gun laws
U.S. District Judge Kari A. Dooley wrote that the plaintiffs have a high probability of success in their challenge. Meanwhile, the state has not yet presented historical evidence that the arbitrary ban meets Bruen’s requirements.
“The Court concludes that Plaintiffs have met their burden of establishing a likelihood of success on the merits,” Dooley concluded. “The statute is presumptively unconstitutional, and Defendants have not met their burden of demonstrating that the statute is consistent with our nation’s history of firearms regulation.”
Without the injunction, Glock and similar semi-automatic and “convertible” handguns would have been illegal to sell or own.
Upstanding companies are not punished for third-party illegal acts
These popular pistols feature cruciform triggers, which critics charge may be easily–and quite illegally–converted with a simple device to function in fully automatic mode.
Dooley ruled that the respected manufacturer is not responsible for what third-party criminals do. Something that is already a felony.
“Here, there is no dispute that handguns with a cruciform trigger bar (in an unconverted state) are not only safe, but extremely popular for purposes of self-defense, and their possession and carry rights are protected by the Second Amendment,” she further wrote.
Dooley warned that an upstanding industry is unfairly targeted by some radical lawmakers for its constitutionally guaranteed products being abused by criminals who do not care if they break the law.
Such tactics could drive the auto industry and many others into the ground. And building cars, like most other things, is not protected by the U.S. Constitution.
