California’s anti-Second Amendment establishment faces yet another strong legal challenge after gun rights groups last week filed a lawsuit challenging two cities’ handgun rationing scheme.
The Firearms Policy Coalition (FPC), the California Gun Rights Foundation, and an FPC member are fighting Los Angeles and Inglewood leaders on this crucial issue. Both mandate that only one handgun may be purchased in 30 days.
This should not even be a discussion.
Cities continue to ignore ruling that slammed the door shut on firearm rationing
The Ninth Circuit emphatically struck down California’s statewide version of the same law. Knowing with absolute certainty that they are violating the court ruling, city officials continue to enforce the nonexistent statute.
The complaint in Lopez v. Los Angeles drives this point home in no uncertain terms.
“The City of Los Angeles and the City of Inglewood each enforce a local ordinance that prohibits any person from purchasing more than one handgun within a 30-day period,” the plaintiffs declared. “These ‘1-in-30 bans’ categorically bar ordinary, law-abiding citizens from acquiring more than one handgun per month, regardless of the citizen’s background, qualifications, or purpose, and back that prohibition with criminal penalties.
There is currently no path around the prohibition, even for extreme emergencies
Never mind if the upstanding gun owner faces a self-defense situation, but they have their hands legally tied from reacting.
At issue are municipal ordinances pre-dating the Ninth Circuit’s ruling. The state law was erased, but the same versions remained on the books in LA and Inglewood. Enforcing these statutes is more than anti-2A officials flipping off the judicial system for abiding by the Constitution and the rule of law.
Even though the wheels of justice are sometimes creaky, this should be an open-and-shut case. Local authorities cannot usurp the Second Amendment while claiming fidelity to justice.
