The Department of Justice (DOJ) put the Philadelphia Police Department (PPD) on notice this week following multiple complaints over arbitrary revocations of carry permits.
On Tuesday, the DOJ Civil Rights Division’s Second Amendment Section began its investigation into the PPD’s so-called “good cause” restriction on carry permits. The agency cited obvious violations of the Second and Fourteenth Amendments by authorities.
There are overdue and much-needed changes afoot within the DOJ
Assistant Attorney General Harmeet K. Dhillon launched the probe and, in a news release, explained the constitutional issue with the city’s actions.
“I have directed the Civil Rights Division, through our Second Amendment Section, to defend law-abiding citizens from local authorities who infringe the right to safely carry legal firearms,” Dhillon announced. “Law-abiding Americans, regardless of where they live, should not have to worry that their city will revoke their means of self-defense.”
Crime rates have indeed fallen since the pandemic explosion, but urban dwellers still face inexcusable threats to their personal safety.
2A rights deserve the exact same legal protection as any other
As The Truth About Guns noted, a major shift is underway within the DOJ. At the same time, it’s expected that the government protects, and the people exercise their inalienable rights to free speech, worship, assembly, etc.
Unfortunately, many officials and lawmakers incredibly choose to ignore the Second Amendment as well as U.S. Supreme Court precedent. They mistakenly believe this freedom is an outlier to the Bill of Rights, some postscript not to be taken seriously.
They are wrong.
Dhillon should be commended for treating the Second Amendment with the same respect that any civil libertarian would give. It was not long ago that the DOJ and other government entities looked on gun rights as something to be grudgingly allowed but severely restricted.
The announcement added that it is obviously unconstitutional for governments to establish arbitrary and vague stipulations on a fundamental right.
