The Department of Justice (DOJ) on Tuesday expanded its recently announced lawsuit against San Jose, California’s highest-in-the-nation concealed carry license fee–nearly $1,600.
The DOJ has now amended its complaint against the city to include its first-in-the-nation requirement that all gun owners purchase liability insurance.
In its amended filing, the agency categorized San Jose’s insurance mandate as a case of “abusive fees.” The city’s so-called Gun Harm Reduction Ordinance, unsuccessfully challenged when it took effect in 2023, now has the attention of powerful federal attorneys.
On top of ridiculous carry permit fees, gun owners must keep liability insurance
The San Jose Police Department (SJPD) noted on its website that all gun owners are required to shell out a government-mandated total annually. Furthermore, law enforcement is ensuring that these fees are dutifully handed over.
“To reduce gun harm in the city of San Jose, the Gun Harm Reduction Ordinance requires firearm owners to obtain and maintain liability insurance and pay an annual gun harm reduction fee,” the SJPD noted. “The insurance requirement took effect on January 1, 2023, and is now being enforced by the San Jose Police Department.”
Money collected from law-abiding citizens is then funneled into nonprofit programs selected by the city’s gun control apparatus.
Previous challenge was unsuccessful, but now it’s the DOJ suing
The National Association for Gun Rights (NAGR) filed a legal challenge against the program before the ink was dry on the law.
Harmeet K. Dhillon, currently an Assistant Attorney General and a proven Second Amendment defender, said at the time that upstanding Americans will foot the bill for this controversial program.
“It’s going to be the law-abiding citizens who actually deter crime by having weapons in their homes who are going to be the ones who bear the burden of this unconstitutional ordinance,” Dhillon announced in her then role as legal counsel for NAGR.
That lawsuit was for naught, but the DOJ’s new challenge may fare much better.
