Georgia is one of several states that enjoys a firearms preemption law. This puts the brakes on anti-gun city leaders who seek to strip Second Amendment rights away from their residents through laws that go beyond those governing the rest of the state.

A battle is shaping up in the Peach State between its leadership and Savannah. The port city recently passed a mandatory vehicle gun storage ordinance that drew the ire of state officials and the National Rifle Association (NRA).

After the national gun rights group requested that the Georgia Attorney General’s Office check into the matter, action quickly followed.

Attorney General Chris Carr sent a letter to Savannah’s leadership cautioning that the city does not have the authority to enact firearm regulations such as the newly minted law. 

Carr declared the gun control ordinance void and warned of possible civil actions if it were enacted or enforced.

The city council had unanimously approved the restrictions supported by Mayor Van Johnson. Among the stipulations are that anyone who has a firearm stolen must report the theft to the Savannah Police Department within 24 hours.

Under the ordinance, all weapons in vehicles must be in a glove compartment, console or locked trunk while the vehicle is unoccupied. Firearms are not permitted to be visible at any time the vehicle is unoccupied, and all locks must be engaged and hatches secured.

An infraction of the shaky new ordinance could result in up to 30 days in jail or a fine of up to $1,000.

There is no word on the city’s response to the warning from the AG. Likely there will be bluster and threats of legal action, which has been attempted by cities in other states against preemption laws. 

These efforts previously met with little success, and there’s no indication that resistance to state authority by Savannah officials will have a different outcome.
