Even in Texas, which respects the right to self-defense like few if any other states, there are instances where that fundamental liberty is questioned. Each case of course is different, but it is surprising to see a person go before a grand jury in what appears to be an obvious instance of protecting themselves and others.

But that’s the situation faced by a Houston security guard. It was nearing midnight on Wednesday, April 3, when a disturbance erupted at an apartment complex. 

According to the Houston Police Department, two residents got into an argument, resulting in a third person calling security. Lt. T. Riley explained how events unfolded.

“Security arrived to handle the incident. When they did, one of the parties in the disturbance threatened to shoot everyone out there. He walked into his apartment and came back with a handgun and pointed it at the other party he was having a disturbance with and then pointed it at the security officer.”

At that point the security officer produced his weapon and fired several shots. He struck the suspect in the torso. 

Responding officers found the unidentified man critically wounded. He was taken to the hospital for treatment but later died.

There were several witnesses interviewed by investigators. The security guard was reportedly licensed and is cooperating with the probe into the deadly encounter. There were no other injuries.

According to reports, the Harris County District Attorney’s Office investigated the case and decided to present it to the grand jury for possible charges. If the facts of the incident are as presented, it is highly unlikely that the shooter will face further legal trouble.

It is disturbing, however, that what on the surface appears to be a cut and dried self-defense issue advanced to the grand jury. Again, Texas leans very heavily toward the rights of intended victims to defend themselves, and the security guard will still likely not face charges.
