It was a confrontation that could have been easily avoided, but an alleged car thief apparently targeted the wrong vehicle. Motor vehicle theft is a bad idea anywhere, but in Texas early Tuesday morning it proved to be a fatal mistake.

It was around 4 a.m. and a resident at a San Antonio apartment complex was on his way to work. The area had been besieged with car break-ins, and he had the misfortune of stumbling across his own vehicle being targeted.

The man headed to work was armed, and in the encounter with the alleged 40-year-old car thief he fired at least one shot. The suspect attempted to drive the vehicle away but did not make it out of the apartment complex.

It was there that he succumbed to his injuries.

The suspect was already dead when first responders arrived, and bullet holes were visible in the SUV’s window.

The San Antonio Police Department is interviewing the vehicle owner, who was identified as a man in his 50s. It is currently unclear if charges will be filed, and Texas law will certainly enter the equation.

Under state statutes, it is legal to resort to deadly force to stop a theft during nighttime hours. However, local prosecutors may take a different route depending on the danger perceived by the intended victim.

One unidentified neighbor said with the crime problem in the area, “it was a time bomb. Something was going to happen soon.” He said the gated complex was recently targeted multiple times by car thieves.

He told reporters that just before 4 a.m. he heard sounds like firecrackers. Then there was silence followed by sirens about 10 minutes later. “When I came outside, they were already roping off the area. Overheard them say something about blood splatter.”
