As bad endings go, a Missouri suspect who picked the wrong house to hit while admittedly high on Xanax could have fared worse last Sunday–but not much.
Officers were called to the Buchanan County residence just before 3 a.m. after the homeowner found a suspect who had allegedly broken in. He was no longer a threat when first responders arrived because the resident exercised his Second Amendment rights to defend life and property.
The allegedly wrongdoer took a bullet into the groin.
Homeowner had no choice but to react with potentially lethal force
Officials identified the suspect as 44-year-old Thomas D. Davis of St. Joseph. He is believed to have taken multiple items from a counter and was leaving when the homeowner confronted him.
Believing Davis was armed and a lethal threat, the resident fired one round at the suspect, who then remarkably ran from the house. He did not get far and was found in a nearby alley before being transported to an area hospital for treatment.
He was released and booked on burglary charges, meaning his wounds were apparently not life-threatening. They may be life-changing, however, which is the chance a person takes when they force their way into a home in the middle of the night.
Charges against homeowner are highly unlikely
Davis told investigators that he was high on Xanax and did not remember even entering the home. He was charged with second-degree burglary.
Any pending actions against the homeowner were not announced, and the initial indication is that he is in the clear. After all, when confronted by a stranger in the middle of the night, there is no time to determine if they are armed, strung out on drugs, or something even more nefarious.
The intended victim had little choice but to respond the way he did and worry about the details later. As for Davis, he received a brutal lesson that could have been far worse than it turned out to be.
