The National Rifle Association (NRA) scored a significant victory for its rank and file last week when a federal judge enjoined the egregious pistol brace rule from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Now millions of law-abiding gun owners are no longer affected by the agency’s arbitrary decision.

The ATF long held that pistol braces do not magically transform handguns into rifles before last year’s controversial change. Suddenly weapons equipped with this popular accessory would be subject to special registration and taxation requirements.

This was due to these common weapons now being redefined as short-barreled “rifles.” With this designation they would fall under the regulations established by the National Firearms Act of 1934.

Along with the radical shift came an NRA lawsuit filed last July in the Northern District of Texas.

The legal action targeted the ATF and Director Steven Dettelbach, and plaintiffs sought to enjoin the new rule. Last week, U.S. District Judge Sam A. Lindsay determined the NRA indeed has standing to represent its membership in its role of protecting their Second Amendment rights.

Lindsay further declared that the ATF did not apply the necessary notice-and-comment period prior to issuing the pistol brace rule. 

The regulatory agency also revised the rule without acknowledging the deluge of comments it received from NRA members and others critical of the unilateral change.

NRA President Charles Cotton reiterated the organization’s mission to battle Washington and “rogue regulators.” He added, “This is a major victory for the NRA, its members, and all who believe in Second Amendment freedom.”

The win means millions of NRA members will be able to continue to utilize pistol braces for sport shooting. The devices were invented over a decade ago to assist disabled veterans to continue the hobby despite their injuries.
