The notable victory over the long-standing federal ban on possessing lawful weapons in a U.S. Post Office building won last September by the Second Amendment Foundation (SAF), the Firearms Policy Coalition (FPC), and two private citizens will stand.
That word came this week when the U.S. Department of Justice (DOJ) filed a motion to dismiss its appeal of the carry ban. This means that present and future members of the 2A organizations benefit from the injunction remaining in effect.
2025 ruling will go forward after DOJ withdrew its appeal
Over two years ago, the plaintiffs challenged the prohibition. Last fall, Judge Reed O’Connor of the Northern District of Texas ruled that the ban violated the Second Amendment’s protection of the right to keep and bear arms.
SAF Senior Director of Legal Operations Bill Sack applauded the “finality and clarity” in the DOJ’s dismissal of the appeal.
“The government appears to now agree, especially in the light of the recent Wolford decision, that the ban on the lawful carry of firearms in post offices fails constitutional muster,” Sack declared.

FPC Founder and President Brandon Combs echoed the significance of the legal victory and rejected applauding the DOJ for what should have been its stance all along.
“But the government deserves no credit for finally abandoning its authoritarian effort to preserve an unconstitutional and immoral law,” Combs said.
Social media critics quickly pounced on the legal victory’s limited application to only members of the plaintiff’s organizations and not all law-abiding gun owners.
While the current SCOTUS makeup is generally friendly to gun rights, a recent decision in CASA v. Trump indicated the high court looked unfavorably on district judges granting nationwide injunctions.
Perhaps a new challenge to such bans can follow the roadmap established by the SAF and FPC. Until that point, membership in these two gun rights organizations means no longer being restricted from lawful carry in most USPS facilities.
