The chaos surrounding state and local bans on popular sporting rifles and standard-capacity magazines shows no signs of abating after Thursday’s decision by the U.S. Court of Appeals for the Third Circuit.
With the ink barely dry on last month’s en banc Third Circuit ruling striking down New Jersey’s prohibitions, the appeals court unfortunately went in the opposite direction this week.
Temporary setback sets the stage for a potentially landmark judicial victory
Garden State lawmakers successfully maintained the controversial ban “pending the Supreme Court’s disposition of movants’ anticipated petition for writ of certiorari or until the time for filing such a petition has expired.”
Even after the July 17 ruling came down and New Jersey State Police announced to gun shops that it would take effect July 31, officials on that very day moved to stop compliance. With the appeals court ruling, they may celebrate what is hopefully a temporary victory.
Imagine any other enterprise connected to free speech or religious activities being boomeranged about in such a ridiculous manner.
For better or worse, Judgment Day is coming
How long states are allowed to strip the right to own the country’s most popular firearms is another question. The calendar is ticking down toward October, when leaves turn and the U.S. Supreme Court hears arguments against such arbitrary bans.
Then, of course, it’s a waiting game until likely June 2027.
But the New Jersey flip-flop, Virginia’s upstart gun control regime, Illinois’ brazen and oppressive anti-2A laws, and dueling court decisions cry out for exactly what SCOTUS was designed to do.
Justices will consider the facts brought before them and determine whether the Second Amendment allows state and local governments to ban law-abiding citizens from owning popular weapons and accessories.
Unfortunately, New Jersey residents must wait until next year–at least–to fully enjoy specific rights guaranteed by the U.S. Constitution.
